Real Estate

The Pop & Asociatii's real estate team advises Romanian and foreign investors, real estate investment funds, users, owners, managers, developers and lenders in all legal and administrative aspects relating to real estate transactions.

The team helps to draw up analyses of the legal status of real estate (also covering the risk of claims being brought by third parties, re-privatization claims, etc.), devises real estate transaction concepts, represents clients in negotiations and draws up agreements and documents required for transaction performance.

Our lawyers help to draw up, organize and carry out development projects (legal framework, investment and construction process, sale of the facilities constructed and negotiations with lessees). We also handle land and mortgage register registration proceedings.

The Pop & Asociatii's team can be of help in cases where security is established on real estate and transactions involving giving real estate over for use (in the form of rent, lease or use agreements, etc.). We also handle Sale and Lease type projects and represent the parties in disputes (also in court) over real estate rights.

The growing complexity of rules and regulations governing the property world gives rise to a host of new issues and challenges in every step along the way for both tenants and investors. In all cases, litigation is on the increase, which implies a general need for better planning of proposed procedures, written document content, particularly contracts, and the type and method of action to be taken.
